I was in Terrell, Texas finding locations for photography and I saw a sign that said Terrell State Hospital.?
I didn’t realize it was a psychiatric hospital until after I had driven on property…(no guard at the front gate) So I was driving throughout the property just to see and take a look. One whole side of the place was an open area with picnic tables and large areas of grass. This same side has two very old buildings that were very clearly not in use. In fact, I was the only car in this whole portion of the property. I got out of my car to take a picture of the abandoned building and this rentacop in a minivan asks me what I’m doing. I told her I was taking a picture of the building. She told me that it was against state law and that I could be fined up to 500,000 dollars. She said it was against state law for the protection of the patients. I’m pretty sure what she said was wrong and I told her that as well. Is it against the law to take pictures on hospital property?
Sarah, you were totally in the wrong. If you really want to photograph the old unused buildings you’ll have to ask permission, in writing, and with an explanation of why you want to take the pictures and your intended use of them.
There is actually a concept called “private property” which apparently people with a camera think doesn’t apply to them. Suppose I have a really unique tree on my property and you, Sarah, take a picture of it from the middle of the public road. You then sell the picture to a calendar company. When I see my tree on that calendar I’m coming after you and the calendar company for invasion of privacy. I’ll win too.
